Alberta Separation Petition Blocked By Court, Government Plans Appeal

Alberta’s court has overturned Elections Alberta’s approval of a citizen-initiated petition for a provincial independence referendum, leaving roughly 302,000 signature sheets locked in a secure facility. The ruling cited the government’s failure to consult four First Nations — the Athabasca Chipewyan, Blood, Piikani, and Siksika Nations — before proceeding with the petition.

Justice Minister Mickey Amery said the United Conservative government will appeal the decision to defend the citizen petition law, emphasizing the legislation’s purpose rather than support for separation. Stay Free Alberta, the separatist group behind the petition, also plans to appeal and request a stay to begin verifying signatures, while Indigenous leaders and legal experts underscore the need to uphold treaty and constitutional rights before any referendum can proceed.

Premier Danielle Smith has expressed opposition to advancing a separatism question, supporting Alberta’s continued place within Canada, though the UCP caucus and cabinet are expected to discuss potential referendum questions in the coming days. Legal analysts suggest that even if appealed, the process may not conclude in time for Alberta’s scheduled October 19 provincial referendum on other issues.
